The Trump administration joined Michigan and Hawaii on Wednesday to prevent the states from applying for damages against fossil fuel companies due to suspected environmental damage.
The complaint submitted against Michigan, the democratic governor of the state of Gretchen Whitmer and Attorney General Dana Nessel, claims that the expected lawsuit in Michigan against the fossil fuel industry affects the US guideline for greenhouse gas regulation and is an “extraordinary extraterritorial reach”. Similarly, the complaint against Hawaii, the democratic governor of the State of Josh Green and the Attorney General Anne Lopez of the state, submitted due to the state's plan, was lodged against fossil fuels for their alleged effects on climate change.
Although neither of the two states have filed a lawsuit, the planned legal measures could increase energy prices and disrupt the regulation of fossil fuels, according to the complaints submitted by lawyers at the US Ministry of Justice (DOJ).
“At a time in which countries should contribute to national efforts to secure reliable sources for domestic energy, Michigan decides to stand in the way,” the complaint said. “The constitution and the laws of this nation do not tolerate this interference,” she continues. The complaint against Hawaii repeats almost identical language.

In May 2024, Nessel announced that the state would act “lawyers and law firms as general deputy lawyers to pursue legal disputes in connection with the effects of climate change caused by the fossil fuel industry on behalf of the state of Michigan.” Nessel continued to accuse the industry of having endangered the well -being of the state, the economy and well -being of the residents by contributing to climate change.
“Due to state restrictions and stress on energy generation, the American population pay more for energy, and the United States are less able to defend themselves against enemy foreign actors,” says both Doj lawsuits.
Hawaii met in Michigan's footsteps on April 28 when the state's governor announced that he had similar intentions to bring fossil fuel companies to court.
“I think we will file a lawsuit against the companies for fossil fuels on Thursday,” said Green on Monday. “You have to pay your share because climate change and the effects of the climate are definitely associated with generations of extra fossil fuel that were burned,” he continued.
“The sovereign interests of the United States include ensuring that states are not the federal law, including the Clean Air Act, or with the exclusive authority of the Federal Government on the intergovernmental and foreign trade, the regulation of greenhouse gas and the national energy policy of the Federal Government,” says the DoJ lawsuits.
President Donald Trump declared a national energy emergency at his first office to expand reliable inland energy production. Later he signed an executive order on April 8 to revive the coal industry, and shortly afterwards he moved several coal -fired power plants from the regulations of the bid period. On the same day, Trump signed an order to protect energy producers from state over -control and explained that “American energy dominance is threatened when the state and local governments are trying to regulate energy beyond its constitutional or legal authorities”.
“No amount of democratic disability will prevent President Trump from the promise he made to the American people, including their promise to unleash American energy,” said Harrison Fields, a spokesman for the White House, in a statement to the DCNF before the government has progressed with the lawsuit. “Radical, external touch democrats should clean up the disasters they created in their own states before trying to promote their failed guidelines for the rest of America.”

Whitmer signed the law on Clean Energy and Jobs in 2023 and demonstrated that Michigan has achieved a 100% generation of green energy by 2040. The law also gave the provision of the state pension authority to overwrite local governments if they approved locations for the infrastructure for renewable energies. “In order to meet this mandate of 100% green energy, the Whitmer management can only do this by taking local control over land,” said Republican Matt Hall at that time of the Daily Caller News Foundation. “These local governments are closest to the people and try to protect the character of their communities.”
In his statement, Hall pointed out one of the controversial parts of the legislation that enables the state's pension regulatory authority – led by the governor's representative – to overwrite the local governments for wind and solar projects, according to Mlive. While Michigan currently uses around 17,000 tomorrow for renewable energies, the Detroit News reported that the state may need up to 209,000 ACRES to reach its Clean Energy targets.
Hawaii has similarly issued guidelines that aim to achieve a “zero emission goal of 100 percent clean energy” by 2045. “
The offices of Green, Whitmer, Nessel and Lopez as well as the White House did not react immediately to the request of the DCNF for comment. The DOJ referred the DCNF to its press release when it was reached for a comment.
